Welcome to Jam Den Rehearsal Studio. By booking, accessing, or using our facility, you agree to these Terms & Conditions.

1. Reservations

All reservations must be made through our online booking platform.

Reservations are confirmed only after full payment has been received.

The person making the reservation is responsible for all guests attending the session.

The individual who books the session must be at least 18 years old.

2. Studio Access

Access is provided through a temporary access code valid only during your reserved session.

Sharing, selling, or distributing access codes is strictly prohibited.

Unauthorized entry into the facility may result in cancellation of your reservation without refund and possible legal action.

3. Reservation Time

Your reservation begins and ends at the scheduled times.

Late arrivals do not qualify for additional rehearsal time.

Customers must vacate the studio promptly at the end of their reservation.

Additional time must be booked through the website and is subject to availability.

4. Payment Authorization

By completing your reservation, you authorize Jam Den to charge the payment method on file for:

  • Equipment repair or replacement resulting from damage

  • Missing or stolen equipment

  • Cleaning fees

  • Overtime charges

  • Any unpaid balances related to your reservation

5. Refusal of Service

Jam Den reserves the right to refuse or terminate service for violations of these Terms, illegal activity, unsafe behavior, or failure to follow House Rules.

LIABILITY WAIVER & ASSUMPTION OF RISK

By entering Jam Den, you acknowledge and agree that:

Participation in rehearsals, music performances, and use of professional audio equipment involves inherent risks.

You voluntarily assume all risks associated with using the facility and equipment.

Jam Den, its owners, employees, contractors, affiliates, and property owners shall not be liable for injuries, illness, death, or property damage arising from your use of the facility.

This includes, but is not limited to:

  • Falls

  • Slips

  • Electric shock

  • Fire

  • Equipment malfunction

  • Loud sound exposure

  • Physical injuries

  • Medical emergencies

  • Any accident occurring inside or outside the facility

You understand that you are solely responsible for exercising reasonable care while using the studio.

You agree to inspect all equipment before use and discontinue use of any equipment that appears unsafe.

By entering the facility, you acknowledge that the equipment and studio conditions are accepted "as is" and agree to use them responsibly.

You are responsible for keeping yourself and your guests safe at all times.

Jam Den does not provide supervision during your session.

CANCELLATION & REFUND POLICY

Reservations may be cancelled or rescheduled up to 24 hours before the scheduled session.

Cancellations made less than 24 hours before the reservation are non-refundable.

Failure to appear for a reservation constitutes a no-show and is non-refundable.

Jam Den may cancel reservations due to emergencies, building issues, or circumstances beyond our control "Acts of God". In those cases, customers will receive a full refund or the option to reschedule.

PRIVACY POLICY

Jam Den respects your privacy.

We collect only the information necessary to:

  • Process reservations

  • Verify identity

  • Process payments

  • Communicate regarding your reservation

  • Improve customer experience

We do not sell or rent your personal information.

Security cameras monitor entrances, exits, hallways, and common areas 24 hours a day for safety and security purposes.

Booking a reservation constitutes consent to video surveillance in monitored areas.

Payment information is securely processed by our payment provider and is not stored by Jam Den.

HOUSE RULES

Please help us maintain a safe, clean, and professional environment.

Before leaving, you agree to:

  • Return all equipment to its original location.

  • Turn off any equipment as instructed.

  • Remove all personal belongings.

  • Dispose of trash in the designated containers.

  • Remove food containers and drink bottles.

  • Close and lock the studio doors upon departure.

Failure to leave the studio in acceptable condition will result in a $50 cleaning fee, which you authorize Jam Den to charge to the payment method on file.

PARKING POLICY

Jam Den provides limited designated parking spaces for public use during your reserved session.

Customers may park directly in front of the Jam Den entrance, where there is sufficient space to accommodate one (1) SUV or up to two (2) small passenger vehicles, provided the vehicles are parked safely and legally.

Under no circumstances may customers or their guests:

  • Block or obstruct the entrance or exit of any neighboring warehouse.

  • Block the main entrance or emergency exits of any business.

  • Park in loading zones, fire lanes, or other restricted areas.

  • Interfere with the normal operation or access of neighboring businesses.

  • Park in spaces designated for other tenants without authorization.

Customers are responsible for ensuring that all members of their party comply with these parking rules. Any vehicle parked in violation of this policy may be subject to towing at the vehicle owner's expense, and Jam Den reserves the right to notify the property owner, property management, towing services, or law enforcement if necessary.

Jam Den is not responsible for any loss, theft, vandalism, damage, towing, or other incidents involving vehicles or personal property left inside vehicles while parked on or near the premises. All vehicles and their contents are parked entirely at the owner's sole risk.

Food & Drinks

Light snacks and beverages are welcome.

Please clean up after yourself.

Alcohol, illegal drugs, and smoking or vaping inside the facility are strictly prohibited.

Respect the Equipment

Do not:

  • Open amplifiers

  • Modify wiring

  • Disconnect installed equipment

  • Remove equipment from the premises

  • Tamper with electrical systems

Noise & Guests

Jam Den is designed for loud rehearsals.

However, customers must respect neighboring businesses when entering or exiting the facility.

The booking customer is responsible for the conduct of all guests.

Guests who violate these policies may result in immediate termination of the reservation.

Illegal Activity

Illegal drugs, weapons (except where protected by applicable law), vandalism, theft, violence, harassment, or any criminal activity are strictly prohibited.

Jam Den will immediately contact law enforcement if it suspects or observes criminal activity.

Lost & Found

Items left behind may be placed in our Lost & Found for a limited period if discovered.

Jam Den is not responsible for lost, stolen, or abandoned personal property and does not guarantee that lost items will be recovered or retained.

Video Surveillance

Customers acknowledge and consent to continuous video surveillance of entrances and common areas for security purposes.

Tampering with surveillance equipment is strictly prohibited.

EQUIPMENT DAMAGE POLICY

All equipment has been inspected and is in working condition prior to your reservation.

The customer agrees to immediately report any equipment malfunction or damage.

The customer is financially responsible for damage resulting from:

  • Negligence

  • Misuse

  • Unauthorized modifications

  • Abuse

  • Theft

  • Missing equipment

  • Intentional damage

Jam Den reserves the right to inspect the studio after every reservation.

If equipment is found to be damaged, missing, or stolen, the customer authorizes Jam Den to charge the payment method on file for:

  • Repair costs

  • Replacement costs

  • Labor

  • Shipping

  • Administrative expenses associated with restoring the equipment

Equipment replacement costs will be based on the current retail value or the reasonable cost of repair.

The customer is responsible for all guests attending the reservation.

If theft or intentional property damage occurs, Jam Den reserves the right to report the incident to law enforcement and pursue all available civil and criminal remedies.

PAYMENT AUTHORIZATION

By completing your reservation, you expressly authorize Jam Den to charge the credit or debit card on file for:

  • Equipment damage

  • Missing or stolen equipment

  • Overtime charges

  • Cleaning fees ($50)

  • Unpaid reservation balances

  • Fees resulting from violations of these policies

You agree that these charges may be processed after your reservation if necessary documentation supports the charge.

GOVERNING LAW

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

Any legal action arising out of or relating to the use of Jam Den shall be brought exclusively in the state or federal courts located in Broward County, Florida, and the customer consents to the jurisdiction of those courts.

DISPUTE RESOLUTION

Jam Den is committed to resolving disputes fairly and efficiently.

Before initiating any legal action, the customer agrees to notify Jam Den in writing and allow at least 30 days for both parties to attempt to resolve the matter in good faith.

If the dispute cannot be resolved informally, it shall be resolved through binding arbitration, except where prohibited by applicable law.

Each party shall be responsible for its own legal fees unless otherwise awarded by the arbitrator or required by law.

CLASS ACTION WAIVER

To the fullest extent permitted by law, all disputes shall be brought only on an individual basis.

Customers waive any right to participate as a plaintiff or class member in any class action, collective action, or representative proceeding against Jam Den Studio LLC.

FORCE MAJEURE

Jam Den shall not be liable for delays, interruptions, cancellations, or inability to provide services due to events beyond its reasonable control, including but not limited to:

  • Hurricanes

  • Tropical storms

  • Flooding

  • Fire

  • Power outages

  • Internet outages

  • Government orders

  • Pandemics

  • Labor disputes

  • Building emergencies

  • Natural disasters

  • Zombie Invasion

  • Alien Invasion

  • AI malware or attack

  • Acts of God

In such cases, Jam Den may reschedule the reservation or issue a refund at its sole discretion.

RIGHT TO REFUSE FUTURE SERVICE

Jam Den reserves the right to refuse future reservations or permanently suspend customers who:

  • Damage equipment

  • Violate House Rules

  • Engage in unsafe conduct

  • Threaten staff, contractors, or other customers

  • Commit theft or vandalism

  • Engage in illegal activity

  • Attempt unauthorized access to the facility

  • Fail to pay outstanding charges

OVERTIME POLICY

Your reservation includes only the time you have reserved.

Customers who remain in the studio beyond their scheduled reservation may be charged additional time at the applicable hourly rate, billed in increments determined by Jam Den.

If overstaying causes delays or affects another customer's reservation, Jam Den reserves the right to charge additional administrative fees and deny future reservations.

INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Jam Den Studio LLC, its owners, officers, employees, contractors, affiliates, landlords, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the facility

  • Your guests' actions

  • Violation of these Terms

  • Damage to the facility or equipment

  • Personal injury caused by your actions or negligence

  • Any unlawful acts occurring during your reservation

LIMITATION OF LIABILITY

To the fullest extent permitted by law, Jam Den Studio LLC shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to:

  • Lost profits

  • Lost business opportunities

  • Lost recordings

  • Lost data

  • Missed performances

  • Travel expenses

  • Hotel expenses

  • Emotional distress

Jam Den Studio LLC maximum liability for any claim shall not exceed the amount paid for the reservation giving rise to the claim, except where prohibited by law.

ASSUMPTION OF EQUIPMENT CONDITION

By entering the facility, you acknowledge that you have inspected the rehearsal room and equipment and accept them in their current condition.

If any equipment appears damaged, unsafe, or malfunctioning, you agree to stop using it immediately and notify Jam Den Studio's representative before continuing your session. Call: (305)731-1710

Failure to report an issue before use may result in the customer being held responsible for damage discovered after the reservation.

EMERGENCY PROCEDURES

Customers are responsible for immediately contacting 911 in the event of:

  • Fire

  • Medical emergency

  • Gas leak

  • Electrical hazard

  • Criminal activity

  • Any situation requiring emergency assistance

After contacting emergency services, customers should notify Jam Den Studio LLC representative as soon as reasonably possible. Call: (305)731-1710

Jam Den is not responsible for providing on-site emergency personnel or medical assistance.

ELECTRICAL SAFETY

Customers acknowledge that the studio contains professional electrical equipment, audio systems, amplifiers, speakers, cables, and power distribution devices.

Customers agree:

  • Not to modify electrical wiring.

  • Not to overload electrical outlets.

  • Not to bypass safety devices.

  • Not to unplug permanently installed equipment.

  • To use equipment only as intended.

Jam Den Studio LLC shall not be responsible for injuries resulting from misuse of electrical equipment.

NO BAILMENT OF PERSONAL PROPERTY

Jam Den Studio LLC does not assume custody or control of any personal belongings brought into the facility.

Any property left behind is left at the customer's sole risk.

Although Jam Den may maintain a Lost & Found area as a courtesy, Jam Den assumes no responsibility for locating, storing, safeguarding, returning, or replacing lost or forgotten property.

VIDEO SURVEILLANCE CONSENT

For the protection of customers and property, Jam Den Studio LLC operates continuous video surveillance in entrances, exits, hallways, and common areas.

By entering the premises, customers consent to the recording of their image in monitored areas.

Tampering with, obstructing, or disabling surveillance equipment is strictly prohibited and may result in immediate termination of the reservation, additional charges, and referral to law enforcement.

SEVERABILITY

If any provision of these Terms & Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

ELECTRONIC AGREEMENT & DIGITAL SIGNATURE

By checking the required acceptance box during the online booking process, you acknowledge that you have read, understood, and voluntarily agree to these Terms & Conditions in it's entirity.

Your electronic acceptance constitutes your legal signature and is legally binding to the fullest extent permitted by applicable law.

CHARGEBACK POLICY

By completing your reservation, you agree not to initiate a chargeback or payment dispute for services that were provided in accordance with your reservation.

In the event of a chargeback or payment dispute, Jam Den Studio LLC reserves the right to submit any relevant documentation, including but not limited to:

  • Reservation records

  • Payment confirmation

  • Access code logs

  • Entry and exit timestamps

  • Security camera footage from monitored areas

  • Photographs documenting the condition of the studio before and after your reservation

  • Communication records

  • Signed electronic agreements

Fraudulent or abusive chargebacks may result in the customer being held responsible for any resulting fees, collection costs, attorney's fees (where permitted by law), and permanent suspension from using Jam Den.

ACCESS LOGS & DIGITAL RECORDS

Customers acknowledge that Jam Den Studio LLC maintains electronic records for security and operational purposes, including:

  • Reservation history

  • Access code activity

  • Entry and exit times

  • Payment history

  • Security camera recordings in monitored areas

These records may be used to investigate property damage, theft, unauthorized access, payment disputes, criminal activity, or violations of these policies.

HEARING SAFETY

Music rehearsals may expose customers to sound levels capable of causing temporary or permanent hearing damage.

Customers are encouraged to use hearing protection whenever appropriate.

By using the facility, customers voluntarily assume all risks associated with exposure to loud sound and waive any claim against Jam Den Studio LLC arising from hearing-related injuries or conditions.

EMERGENCY CONTACT INFORMATION

Customers are encouraged to provide an emergency contact during the booking process.

Jam Den may use this information only in the event of an emergency affecting the customer during their reservation.

PERSONAL PROPERTY

Customers are solely responsible for all personal belongings brought into the facility.

Jam Den is not responsible for:

  • Lost property

  • Forgotten equipment

  • Theft

  • Damage to personal items

  • Musical instruments

  • Computers

  • Cameras

  • Recording equipment

  • Pedals

  • Phones

  • Wallets

  • Jewelry

  • Cash

Please verify that you have all belongings before leaving the studio.

SECURITY OF ACCESS CODES

Temporary access codes are confidential and not transferable.

Customers agree:

  • Not to share access codes.

  • Not to post codes online.

  • Not to provide codes to unauthorized individuals.

  • Not to allow unauthorized persons to enter the facility.

Customers are responsible for anyone entering the facility using their access code.

MINORS

Customers under the age of 18 may only enter the facility under the direct supervision of a responsible adult who has completed the reservation and accepted these Terms & Conditions.

The supervising adult accepts full responsibility for all minors attending the session.

PET POLICY

Absolutely no pets or animals are permitted inside the studio for safety reasons; exposing your pet to loud noises can affect their audition and stress your pet. Keep them safe at home

SMOKE-FREE FACILITY

Smoking, vaping, e-cigarettes, cannabis, illegal drugs, or any combustible substances are strictly prohibited anywhere inside the facility.

Violation of this policy may result in:

  • Immediate termination of the reservation

  • Cleaning charges

  • Additional damage fees

  • Permanent suspension from future bookings

FOOD & BEVERAGE RESPONSIBILITY

Customers are responsible for properly disposing of all food, beverages, bottles, cans, and trash before leaving.

Excessive spills or stains requiring professional cleaning may result in additional cleaning charges beyond the standard $100 cleaning fee.

PROHIBITED ACTIVITIES

The following activities are strictly prohibited:

  • Fighting

  • Threatening behavior

  • Harassment

  • Vandalism

  • Sex or any other immoral activity

  • Nudity

  • Theft

  • Graffiti

  • Possession or use of illegal drugs

  • Excessive intoxication

  • Tampering with security equipment

  • Unauthorized commercial activities

  • Gambling

  • Open flames or fireworks

  • Dangerous or reckless conduct

  • Bringing hazardous materials onto the premises

Jam Den reserves the right to terminate the reservation immediately and notify law enforcement when appropriate.

FIRE SAFETY

Customers agree to familiarize themselves with the location of emergency exits and fire extinguishers upon entering the facility.

Emergency exits must never be blocked.

Customers shall immediately report any fire, smoke, unusual odors, electrical hazards, or unsafe conditions.

Jam Den shall not be responsible for injuries or losses arising from fire or emergency situations beyond its reasonable control.

DAMAGE INSPECTION

Jam Den reserves the right to inspect the rehearsal room immediately before and after every reservation.

Photographs and video documentation may be used to determine responsibility for damages.

Failure to report damage before beginning your session may result in the booking customer being held responsible for damage discovered afterward.

COLLECTION OF UNPAID BALANCES

If additional charges remain unpaid, Jam Den reserves the right to pursue all lawful collection remedies, including referral to a collection agency or legal action where appropriate.

The customer may be responsible for reasonable collection costs, court costs, and attorneys' fees if permitted by law.

WEBSITE & BOOKING PLATFORM

Jam Den Studio LLC is not responsible for interruptions caused by:

  • Internet outages

  • Third-party booking software failures

  • Payment processor outages

  • Website maintenance

  • Cybersecurity incidents beyond our reasonable control

Reservations affected by technical issues will be handled in good faith, with rescheduling or refunds considered when appropriate.

PROMOTIONAL CONTENT

Customers grant Jam Den permission to use photographs or videos voluntarily shared with Jam Den and tagged on social media for promotional purposes.

Jam Den will not enter the rehearsal room to create promotional content without the customer's permission.

MODIFICATION OF POLICIES

Jam Den Studio LLC reserves the right to modify these Terms & Conditions and all related policies at any time.

The version in effect at the time of the reservation shall govern that reservation.

Updated policies will be posted on the Jam Den Studio website.
